Based on the findings of this study, the definition of mandatory supervision and selective author of incomplete and can not be passive use of mandatory supervision and be confined to private law because the nature of monitoring according to the observer status and independence or lack of independence, he is determined and nature Guardian Council election monitoring multiple reasons "mandatory supervision" and the interpretation of the Guardian Council confirms the analysis and interpretation.     براساس اصل نود و نهم قانون اساسی نظارت بر انتخابات بر عهده شورای نگهبان است. درباره‌ی ماهیت این نظارت دیدگاه‌های متفاوتی مطرح شده است؛ برخی ماهیت نظارت را استصوابی و برخی آن را استطلاعی می دانند. نظریه‌ی دیگری که در این زمینه مطرح شده است، نظریه «نظارت انتخاباتی» است. بر اساس این نظریه، کاربرد نظارت استصوابى و استطلاعى، هر کدام به تنهایى در حوزه حقوق خصوصى است، ولى نظارت بر انتخابات از مقوله حقوق عمومى است. از این‌رو، ماهیت نظارت شورای نگهبان بر انتخابات، نه استصوابی یا استطلاعی، بلکه «نظارت انتخاباتی» است. در این نوشتار نظریه مذکور با رویکردی فقهی ـ حقوقی بررسی و نقد می‌شود. براساس یافته‌های این تحقیق، تعریف نویسنده محترم از نظارت استصوابی و انتخابی کامل نیست و نمی‌توان کاربرد نظارت استصوابی و استطلاعی را به حقوق خصوصی منحصر نمود، زیرا ماهیت نظارت با توجه به جایگاه ناظر و استقلال و یا عدم استقلال وی تعیین می‌شود و ماهیت نظارت شورای نگهبان بر انتخابات به ادله متعدد «نظارت استصوابی» است و تفسیر شورای نگهبان نیز مؤید این تحلیل و تفسیر است.        https://www.roir.ir/article_62836_20c361dae26c548a297c7bd43b5f6ffa.pdf
